Terms of Service

Welcome to Velan.fit (“Velan”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at https://velan.fit (the “Site”) and any purchases of products made through the Site (collectively, the “Services”).

By accessing or using the Site, or by purchasing any product from us, you agree to be bound by these Terms. If you do not agree, you must not use the Site or our Services.

Important: This document is a general template and does not constitute legal advice. You should have a qualified lawyer in Trinidad and Tobago review and adapt it before publishing.

1. Who We Are

References in these Terms to “you” or “your” mean the individual or entity accessing or using the Site.

2. Eligibility

By using the Site, you represent and warrant that:

  • You are at least the age of majority in your place of residence (in most cases 18+), or you have the consent of a parent or legal guardian to use the Site and make purchases; and

  • You have the legal capacity to enter into a binding contract with us.

If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

3. Our Services & Products

Velan sells apparel and related products, many of which are produced using print-on-demand partners. That means products are manufactured and fulfilled after you place an order, rather than being held in stock.

While we strive for accuracy, product images, colours, and mock-ups shown on the Site are for illustration only. Actual products may vary slightly in colour, placement, and size of prints due to screen differences, manufacturing tolerances, and fabric variations.

We reserve the right to discontinue any product at any time.

4. Accounts and Security

You may be able to create an account on the Site to save your details and order history.

  • You are responsible for keeping your login information confidential.

  • You are responsible for all activity that occurs under your account.

  • You agree to notify us promptly of any unauthorised use of your account or any other breach of security.

We reserve the right to suspend or terminate accounts that appear to be compromised, fraudulent, or in violation of these Terms.

5. Orders & Acceptance

  1. Placing an order

    • When you place an order through the Site, this is an offer to buy products from us.

    • We may accept or decline your order at our discretion, including for reasons such as payment issues, suspected fraud, or product unavailability.

  2. Order confirmation

    • After you place an order, you may receive an email confirmation acknowledging receipt.

    • This confirmation does not guarantee acceptance of your order; your order is accepted when we dispatch the product or explicitly confirm acceptance.

  3. Order cancellation by us
    We may cancel an order and issue a refund (if payment has been captured) where:

    • The product is unavailable or discontinued;

    • We detect an error in pricing or product information;

    • Payment is declined or flagged as high-risk; or

    • We suspect fraud or misuse.

6. Prices, Currency & Taxes

  • All prices shown on the Site are in the currency indicated at checkout (typically USD) and are subject to change without notice.

  • Prices do not always include shipping, taxes, customs duties, or other applicable charges unless explicitly stated.

  • You are responsible for any applicable sales tax, VAT/GST, customs duties, or import fees charged by your country or region, including the United States, Canada, Panama, and Colombia.

If we discover an obvious pricing error, we may cancel your order or contact you to confirm whether you wish to proceed at the correct price.

7. Payments

Our store is powered by Shopify, and we use Shopify’s payment gateways and other third-party payment providers to process payments.

By submitting payment information, you represent and warrant that:

  • You are authorised to use the payment method provided;

  • The information you provide is accurate and complete; and

  • You authorise us (and our payment processors) to charge the total amount of your order, including applicable taxes, shipping, and fees.

We do not store full payment card details on our own servers. Payments are processed securely by third-party providers.

8. Shipping & Delivery

8.1 Print-on-Demand Fulfilment

We use Printify and/or other third-party print-on-demand providers (“Fulfilment Partners”) to produce and ship our products. This affects production times, shipping methods, and tracking.

  • Production time: Typically a few business days from when your order is confirmed, but this can vary by product, season, and demand.

  • Shipping carriers: Selected by our Fulfilment Partners and may differ by destination.

Because production and shipping are handled by third parties, delivery dates are estimates only and not guaranteed.

8.2 Shipping Destinations

Our primary target markets are:

  • United States

  • Canada

We may ship to additional destinations at our discretion. If we cannot ship to your location after you place an order, we will cancel and refund your order.

8.3 Shipping Costs

Shipping costs are calculated at checkout based on the items in your order, your shipping address, and the shipping method available.

From time to time, we may offer promotional or free shipping subject to conditions (e.g., minimum order value, specific countries).

8.4 Customs, Duties & Import Fees

For international shipments, including to the US, Canada, Panama, and Colombia:

  • Customs duties, import taxes, and other fees may be charged by your local customs authorities.

  • These charges are your responsibility and are not included in our product or shipping prices unless expressly stated.

We have no control over these charges and cannot predict what they may be.

8.5 Risk of Loss

Risk of loss and title for products pass to you when the carrier confirms delivery to the shipping address you provided.

If a package is marked as delivered but you have not received it, you should first contact the carrier and then reach out to us at velanfitofficial@gmail.com so we can review the situation.

9. Returns, Exchanges & Refunds

Because many of our products are made-to-order using print-on-demand, we typically do not accept returns or exchanges for:

  • Change of mind;

  • Incorrect size chosen; or

  • General dislike of the product if it matches the product description and mock-ups.

However, we want you to be happy and will always work with you in cases where there is a genuine issue.

9.1 Defective or Incorrect Items

If you receive a product that is:

  • Damaged or defective;

  • Incorrect (wrong item, size, or design compared to your order); or

  • Missing items from your order,

please contact us at velanfitofficial@gmail.com within 7 days of delivery with:

  • Your order number;

  • A description of the issue; and

  • Clear photos of the product and packaging.

Where we confirm a fault or error, we will, at our discretion:

  • Replace the item; or

  • Issue a partial or full refund.

9.2 Return Process

Because products are shipped directly from our Fulfilment Partners, any returns or replacements may involve specific instructions. Do not return items to the return address on the shipping label unless we explicitly instruct you to do so.

We reserve the right to refuse returns or refunds if:

  • The issue is not reported within the stated timeframe;

  • The product has been clearly used, washed, or damaged after delivery; or

  • We reasonably believe the claim is fraudulent or abusive.

10. Promotions & Discount Codes

From time to time, we may run promotions or offer discount codes. Each promotion is subject to its own specific terms, which may include:

  • Eligibility criteria;

  • Time limits;

  • Applicable products or collections; and

  • Limits on use per customer.

We reserve the right to modify or cancel promotions at any time.

11. Intellectual Property

All content on the Site, including but not limited to logos, trademarks, brand names, product designs, graphics, photos, videos, text, and layout (“Velan Content”), is owned by or licensed to Velan.fit and is protected by copyright, trademark, and other intellectual property laws.

You may not, without our prior written consent:

  • Use our trademarks or logos;

  • Reproduce, distribute, modify, create derivative works of, or publicly display any Velan Content;

  • Use any images or designs on the Site for your own commercial purposes.

12. User Content (Reviews, Social Media, etc.)

If you:

  • Post reviews or comments on the Site; or

  • Tag or mention our brand (e.g., @velan.fit or using #VelanFit) on social media in connection with our products,

you grant Velan.fit a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, and display that content in any media for marketing, promotional, or other business purposes.

You represent that:

  • You own or control the rights to any content you submit or share; and

  • Your content does not infringe the rights of any third party or violate any law.

We may remove or refuse to display user content at our discretion.

13. Third-Party Services

Our Site and Services rely on third-party platforms and providers, including but not limited to:

  • Shopify (e-commerce platform);

  • Printify and other print-on-demand partners (production and fulfilment);

  • Payment processors and shipping carriers.

Your use of these third-party services may be governed by their own separate terms and privacy policies. We are not responsible for the content, policies, or practices of third-party websites or services.

14. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or abusive purpose;

  • Attempt to gain unauthorised access to any portion of the Site or related systems;

  • Interfere with or disrupt the operation of the Site or any servers or networks connected to it;

  • Use bots, crawlers, or scraping tools to access data from the Site without our consent;

  • Upload or transmit viruses, malware, or any harmful code.

We may suspend or terminate your access to the Site if we reasonably believe you have violated these rules.

15. Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Site and all products and Services are provided on an “as is” and “as available” basis;

  • We do not warrant that the Site will be uninterrupted, secure, or error-free;

  • We do not guarantee that colours, materials, or fits will appear exactly as on your screen.

Any implied warranties or conditions (including merchantability, fitness for a particular purpose, or non-infringement) are disclaimed to the maximum extent allowed by applicable law.

Some jurisdictions do not allow limitations on implied warranties, so these exclusions may not fully apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Velan.fit, its owners, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;

  • Any loss of profits, revenue, data, or goodwill;

arising out of or in connection with:

  • Your access to or use of the Site or Services;

  • Your purchase or use of our products; or

  • Any delay or inability to use the Site or Services,

even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the total amount you paid to us for the product(s) giving rise to the claim.

Some jurisdictions do not allow limitations of liability for certain damages, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Velan.fit and its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Site or Services;

  • Your violation of these Terms; or

  • Your violation of any rights of a third party.

18. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

By using the Site, you consent to our collection and use of personal data as described in our Privacy Policy.

19. Governing Law & Jurisdiction

These Terms and any disputes arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of Trinidad and Tobago, without regard to its conflict of law rules.

You agree that the courts of Trinidad and Tobago shall have exclusive jurisdiction over any dispute or claim arising from or relating to these Terms or your use of the Site, subject to any mandatory consumer protection rules that apply in your country of residence.

20. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.

  • Changes will take effect when posted on the Site unless a later date is stated.

  • Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you should stop using the Site and Services.
